Acceptable Use Policy

What you are and aren't allowed to do with your commissioned images/art! 

General:
> Commissioners are free to post their commission anywhere

they please and are encouraged to do so!


> Commissioners MAY NOT remove, edit or hide my signature and or watermark.

> Commissioners are NOT allowed to sell the art as prints, shirts, posters, etc.

> Commissioners are allowed to make their own mugs/shirts/etc for personal use.

> Commissioners are allowed to chop/crop the art within reason for: Icons, Site ID’s, etc.

> Commissioners are allowed to use their commissions on their personal site, banners etc.

> Commissioners may request the full resolution PSD file.

 > Commissioners may NOT ask to have works removed from

my gallery due to breakups/lost friendships etc. 

> Commissioners may attempt to request to remain anonymous, but I have

the right to deny this or publicly link accounts/profiles to which are tied

with your art or character. If you are subject to public scrutiny that is not my responsibility

to handle, deny or take part in.  I WHOLE  HEARTEDLY PREFER TO PUBLICLY POST

CONTENT. I prefer to remain opaque to my audience.

> You may NOT upload artwork not made for you without consent. This includes

for role plays, icons, Id’s etc. If found doing so the entire account will be subject to a

DMCA legal takedown. You will not be warned. Don't wake up to an ENTIRELY

deleted gallery or to missing images you aren't even aware have gone missing.

> You may not pirate my art in any fashion by uploading it elsewhere, this is

especially true in the case of art purchased in a bundle or deal and not to be distributed

publicly by anyone else. Yes. Comics as well. You CAN be LITERALLY fined for doing so.

> If you intend to trace or copy my works, you must credit me at the very least.

>> I would prefer you not sell images you traced/copied from me in the form

of commissions, YCHs or otherwise. Doing so will earn you a public Blacklist/Artist

Beware and you will be reported to site staff, and subject to a DMCA takedown.

>> Please do not use my artwork to BOLSTER concept sales. Art you purchase

OF a concept is for YOU and does not physically alter a concept. There are VERY few

applicable exceptions. The concept is it's OWN item and should be sold outside of

rights to repost prior artwork.

Terms Of  Service

A generalized rundown! 

First and foremost, should you secure a commission from me, you need to know you're compensating me for my TIME SPENT. You are accepting my work based not only on my visible skill, but also my knowledge of 10+ years doing freelance, tattoo work, illustrations and cartoons. I will make suggestions if I foresee issues AND I am always open to explain the reasoning. Please be aware this is NOT a cookie cutter process. I am not a copy machine, a printer or a replicator. 

 > By commissioning me you agree to my terms of service as well as acknowledge

them. Your "TOS" for your personal character does not overwrite mine, you are

not rendering me a service, I am rendering you a service. 

> As the artist, I have the right to refuse a commission request without reason,

though I often give one. You do not get to make demands and will simply be met with silence.

> If a client is rude, rushing, harassing or otherwise they will be rejected

and/or refunded. I may choose to provide whatever stage of work I have finished.

Then you will be blocked. You will not be given warning or reason and that's within my rights.

> Commissioners are welcome to contact me at any time about 
their commission

status. Reply times may vary, however I will always answer given enough time.

> Proper reference sheets are important for commissions. Please note

what I find to be a proper reference. Shaded images, second life models,

and traditional images do not applyunless they have digital color bars/samples 

somewhere on the image or elsewhere. In the case of second life models/internet

modes from MMOs etc. , they are only acceptable resource material if you're translating

one from 3d model to art. This is considered a unique case and will require unique

details which we willdiscuss at length.

> When speaking to me, please be clear/concise and do not speak

in “txt” talk, roleplay or use "owo" etc.. Please be descriptive, verbal

and have the things you need ready also please be OPEN and let

me know about mistakes! I am willing to work on something until

it's "right", not just acceptable. 

> If English is not your mother tongue that is fine! I will do my best to

work with you, just give me a warning! It may do you well, however, to

find a friend who can possibly help you translate. Translators who offer

their services for any languages will be compensated for their time and effort. 

> Example images for references are always helpful, this includes: poses,

body types, background/scene ideas, species and so forth. I will ALWAYS

credit these sources, if you see one missing please don't hesitate to speak up

and mention it! Some images use upwards of 20 images and I often loose links

despite my best efforts!

> If I find you to be under 18 and trying to purchase content, you will

be blacklisted and blocked. I DO NOT sell to underage persons within

my knowledge. Legally you must be 18 or older to purchase content of any kind

from me online. Period. This includes SFW content.

If I find out that you're practicing or apologetic towards: Zoophilia, underage porn, abuse etc. I will absolutely ghost you, block you and be V E R Y vocal about why.  This includes people who think it's okay to hate on/degrade or punch down on literal children. 

How long will this take?

How long will this take again?

> If anything may hinder your commission process, you will be alerted to wait times before you send any payments. If anything hinders the process further you will be continually updated and kept in contact with, I have 10 years under my belt as of 2020.

> My wait time ranges and is heavily based on how many people are in front 
of you and how picky they are, how many edits they need, how fast they respond, and other such variables that I can't predict and often take the most of my time. From the start of an image to the end, however, it only takes me 6-12 hours (for general images with no background). I'm quick at what I do, but at the mercy of response times and other customers.

> Also note I am diagnosed with PCOS, Grave's disease/Hashimoto's encephalopathy and 3 types of Epilepsy. I am under constant care for my illnesses but they are not always stable, they are chronic and not curable. You are kept up to date as well as I am able, but if this is something that worries you or is too strenuous on your psyche' then I suggest not commissioning me.

> I check my messages every day if not every other day for customers, unless 
something serious has happened, you should hear from me rather promptly.

> In the event of serious illness, you will be contacted by husband {shinboon} 
should I be unable to contact you directly.

W.I.P.s & Edits. 

Can I see? Can you change this?

> I provide WIPS as I see fit, you do not get to demand them :'), I tend to provide: an initial rough draft sketch (to go over an idea), a second draft sketch, a cleaned up sketch, line art, flat color, and so on. I provide them as needed for clarification. They're to help me gauge what's going on, not to power your ego, pass around chat rooms, or to play into hype. This isn't a Triple A release, please don't treat it that way.

> If you have a very simple, straightforward or clean idea that doesn't need much 
editing/help or adjustment, you won't get wips. Waiting on responses and confirmation is by far THE bulk of my time, simple content that takes me a handful of hours just doesn't need it. 

> Edits are case by case basis and I personally make as many as 
I need to in order to assure quality to the best of my abilities. You are encouraged to request edits, though going over 2 hours worth of editing for extra picky customers WILL incur a fee for my time.

> You are encouraged to point out issues during line art and flat color stages 
of progression, again, after this they often become too cumbersome to be worth while fixing for most customers. Once past the flat coloring, most edits become incredibly cumbersome, and may not be fixable without an additional fee for the amount of time required. In some cases, money will not be enough to compensate on lost time and I may refuse to do any edits or additional content regardless of money. Begging, pleading, coaxing, or otherwise ignoring my answer will get you blocked. If I say no, I mean it. 

> If the reason the edits need to be made can be discerned to inadequate 
reference material you will be required to pay for the time spent on those edits. You may make as many as needed, but a fee will be included, I will not be penalized for lacking the materials needed to do the job required of me.

> I WILL NOT edit an image weeks or days after a commission is complete, if you 
need edits at this point you will be required to pay for them and will only be accepted if my list is empty. If have the time to take on the edits. THIS ABSOLUTELY applies to stickers, references, and ALL CONTENT. I CANNOT keep files indefinitely. Please stop expecting this.

> You will have 48ish hours to make sure your commission is edited and 
completed to your preferences once I have provided your completed project. After this period you will no longer be able to request edits.

> Reference sheets are not subject to all of these rules, though you are 
encouraged to speak up as early as you notice issues, you are not dismissed from fees if time goes well beyond my definition of a reasonable limit.

> I would prefer my customers not make edits to their own content if 
they are unsure of what they're doing. If you do brave the file and make your own edits regardless, at least credit yourself so people know I didn't make any rookie mistakes. It really does look bad if you re-upload something and it's poorly edited and don't mention it. People will automatically think I've messed up instead.

Payments/Refunds

> Full refunds can only be given if work has not started and are only given at my discrepancy. Refunds can be given in emergency situations, PM me so we may discuss details.

> If I am unable to complete a commission for reasons known to me, 
I will send a full refund. I do not have to state these reasons.

> If I cancel a commission and refund you, it means something of real severity 
is going on in my life, you are not entitled to art and if I choose to refund you it is not negotiable. Continual begging for the images in any way will result in a block.

> If you have been refunded, you do not get to demand 
finished content and it will not be provided for you.

> I only take USD as payment, please don't send Yen, Rubles, Canadian USD etc. I do consider conversion rates, so if things are unreasonable I will try my best to work with you. In the end we all have to eat. 


> I much less rarely will trade items, art, game currencies/items, or even wishlist specific items. (Flight rising, world of warcraft, etc..) You'll have to note me for specific trades of this nature.

> I can provide a sketch or W.I.P image to a client and then accept 
payment, if you turn down the image I will use the sketch for my own purposes.

> I am often willing to work out payments around pay dates and so forth.

Lost Contact

Where'd ya go?

> In the event of suspension from website, sudden circumstances, major events or something along similar lines, please contact me via email at therileypoop@gmail.com or more preferably on telegram.

> In the event of disappearance you will be given a grace period 
of two weeks before you are removed from my active commission list.

> If you return within 2 months of the initial order and have 
reasonable explanations to your lost contact you will be compensated your image. [i.e. My house burned down, pandemic got me, etc. etc. I'm not here to judge you, I just need to make sure you were genuinely strung up and not just ignoring me :"3. 

> Lost slots will not be given to anyone else, no exceptions, if a commissioner 
cannot be refunded or contacted I will RAFFLE OFF the paid commission to a random follower or keep the payment as a donation after 60 days.

Exceptions to the rules may apply in some cases, note me for details.
